COMITY / RECIPROCITY APPLICATION

Requirements:  Before rendering or offering to render any engineering, surveying, landscape architecture, or architectural services in the state, you Must be licensed.  If the applicant’s file is not completed within six months from the receipt of the application, the file will be destroyed and fees are non-refundable.  It is the responsibility of the applicant to assure the return of completed forms to this office within a reasonable time.  All forms must be complete before any action can be taken on the application.  The requirements met upon initial licensure must be of equal standards under South Dakota laws and acceptable to the Board.  Any disciplinary action taken against the applicant must be reported.  All applicants must have a current license in the state in which they reside.  Completed comity applications will be reviewed at the next board meeting.

Business Requirements:  The business you work for must have a Business License with our office or be exempt before the individual’s license can be issued.  If you are in business for yourself, or employer is a sole proprietor, or firm is a corporation, partnership, LLP or LLC and plans to provide professional services in South Dakota the business must be licensed by this office. If the business you work for is not currently licensed with our office, please submit a Business Entity Certificate of Authorization application to our office.  The Board can take action on both the individual and firm at the same time.

Landscape architects must have a council record from CLARB.

Comity Application fee is $100
Payable by check or credit card.

APPLICATION OPTIONS

  1. You may complete the application online. Pay by credit card, mail a check or submit a credit card authorization form by mail, fax or scan & email.  When completing the application online you will supply your own user ID and password so that you can continue a previously started Comity application.

OR

  1. You may also complete the application by printing a word document.  When submitting your application in this manner please print or type. Pay by mailing a check or submit a credit card authorization form by mail, fax or scanning & emailing.

A. If you are submitting a council record from NCEES, NCARB, or CLARB, please follow these instructions:

 

  1. Complete page 1 of the Comity Application.

  2. Complete the open-book Take Home Exam over South Dakota State Laws and return to this office by mail, fax or scanning & emailing.  You will need to print the Statutes and Rules (Blue Book) from our website or a "blue book" can be mailed to you upon request.

  3. If the business that you work for is not currently licensed with our office, please submit a Business Application.

 

B.  If you are not submitting a council record from NCEES or NCARB, please follow these instruction:

 
  1. Complete all 3 pages of the Comity Application.

  2. Make 5 photocopies of the Confidential Comity Reference Form Complete your portion and submit to 5 references. At least 3 references must be licensed professionals in good standing, as related to your profession, and each reference must have personal knowledge of your experience. Current South Dakota Board members may not be used as references. The reference form must be returned by the referenced individual by mail, fax or scanned & emailed.

  3. Experience Page- Fully describe your work experience. Input up to a total of 10 employment periods beginning with your current employment. Title of position, name of employer, and character of each engagement. Make statements concise and explicit, and include magnitude and complexity of work in which engaged and your duties and degree of responsibility. Leave no gaps in the listing of experience. Explain periods of Military service, illness, unemployment, etc. Provide the name, address, profession and license # of licensed person who supervised your work.

  4. Request an official transcript from the school where you received your degree(s). The official transcript must be mailed from the school where you received your degree(s) to the board office. Include a stamped envelope addressed to this office.

  5. Complete your portion of the State License Verification Form and mail to the state where you passed the written professional examination for initial licensure. There may be a fee required for this service and you may wish to contact that state board first. Include a stamped envelope addressed to this office.

  6. Complete the online open-book Take Home Exam over South Dakota laws. You will need to print the Statutes and Rules (Blue Book) from our website or a "blue book" can be mailed to you upon request.

  7. If the business you work for is not currently licensed with our office, submit a Business Application.


OTHER INFORMATION

Land Surveyor Applicants:  an additional open-book take home exam over South Dakota land surveying rules will be sent to you after our office has received all of the above information.

Sales Tax is imposed on the gross receipts of any person providing architectural, surveying, or engineering services in South Dakota as stated in SDCL 10-45-5 and 10-45-5.2. Information may be obtained from the South Dakota Department of Revenue, telephone 605-773-3311.

A duplicate copy of the comity application should be made for your records.
